Terms of Service

1. Acceptance

These Terms of Service ("Terms") form a binding agreement between you (the "Customer") and MyHotelOps ("MyHotelOps", "we", "us") regarding your use of the MyHotelOps service. By creating an account or using the service, you agree to these Terms and the Privacy Policy. If you are agreeing on behalf of a company, you represent that you have authority to bind that company.

2. The Service

MyHotelOps provides hospitality operations software and an external market-intelligence layer for hotel property owners and their teams. The service includes (without limitation): media cataloging, work-order management, event management, IT documentation, digital signage, branded arrival pages, billing, team management, and the Revenue Intelligence module described in section 5A below.

MyHotelOps is not a property management system, booking engine, reservation system, or revenue management system. Market Intelligence is a decision-assist tool that surfaces external market signals; it does not automatically set, change, or publish your room rates, and we never alter any rate without an explicit operator action.

We may add, change, or remove features over time.

3. Accounts

  • You are responsible for all activity under your account and for keeping your password confidential.
  • You must use accurate, current information when creating an account and keep it up to date.
  • You must promptly notify support@myhotelops.com of any unauthorized access or use.

4. Subscription, fees, and billing

MyHotelOps is sold on a monthly per-property subscription billed in advance through Stripe. Pricing for new customers is the rate displayed at signup or in your written agreement. Setup fees, if applicable, are billed on the first invoice.

We may change subscription prices on at least 30 days' notice; changes apply to the next billing cycle. Past-due accounts may be suspended or restricted; we will provide notice and a reasonable cure period before suspension.

Except as required by law, fees are non-refundable. You can cancel at any time from your billing page; cancellation takes effect at the end of the current billing period.

5. Customer content and license

You retain all rights to the content you upload to MyHotelOps("Customer Content"). You grant MyHotelOps a worldwide, non-exclusive, royalty-free license to host, copy, transmit, and display Customer Content solely to provide the service.

You are responsible for the legality of your Customer Content and for having the rights to upload it.

5A. Market Intelligence module

The Market Intelligence module (the "RI Module") surfaces external commercial signals around your property, competitor rates, demand events, weather, search demand, and review sentiment, and produces a daily executive briefing with non-binding pricing suggestions.

Nature of the service.

  • The RI Module is a decision-assist tool. It surfaces information and produces recommendations; it does not set, change, or publish any rate. Any pricing decision, channel update, or guest-facing action remains entirely with you.
  • Recommendations are informational only and are not financial, tax, legal, or revenue-management advice. You should evaluate each recommendation against your own knowledge of your property and market before acting.
  • Signal data is sourced from third-party services (publicly listed OTA rates, ticketing platforms, weather services, mapping APIs) and public web pages. We do not guarantee completeness, accuracy, freshness, or fitness for any particular purpose of third-party data.

Authorization to ingest public commercial data about your property.

By accepting these Terms, you authorize MyHotelOps to periodically read public commercial data about your property and its local competitive set, specifically: review listings (e.g. TripAdvisor, Google), place metadata (Google Places), and the events / weather / market context sources catalogued in our Privacy Policy. This authorization is granted once, at account creation, and does not require a separate per-data-source confirmation in-app. You represent that you are authorized to grant this permission on behalf of your property.

We collect only data displayed publicly by the upstream source, at a rate consistent with that source's terms of use. We do not collect personal information about individual reviewers, reviewer names are HMAC-hashed before storage (see the Privacy Policy for details).

Operator-supplied inputs.

  • You may optionally provide your property's Google Place ID, ADR floor/ceiling, and similar positioning inputs on the in-app Settings hub. These identifiers narrow the search to the correct listing, the authorization to read public data about that listing is the one you granted by accepting these Terms.
  • You may clear any of these inputs at any time, which halts further collection of the corresponding signal.

Third-party logos.

Logos of third-party data sources that appear in our marketing site identify the services we monitor; their inclusion does not imply commercial partnership unless explicitly noted. All trademarks are property of their respective owners.

6. Acceptable use

You agree not to:

  • Violate any law or third-party rights.
  • Upload malicious code, scrape the service, or attempt to circumvent security controls or rate limits.
  • Use the service to send spam, phishing, or other unsolicited communications.
  • Reverse engineer the service except where allowed by applicable law.
  • Resell, sublicense, or use the service to operate a competing product.

7. Suspension and termination

We may suspend or terminate your access if you breach these Terms or if your account is past due. You may terminate at any time by cancelling your subscription. On termination, your right to use the service ends; Customer Content may be retained for up to 30 days as described in the Privacy Policy.

8. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

Without limiting the foregoing: the Market Intelligence module's briefings, recommendations, comp-set detection, and demand-signal feed are produced from third-party data and statistical heuristics. They are informational only, do not constitute professional revenue-management, financial, legal, or tax advice, and may be incomplete, delayed, or incorrect. You are solely responsible for any decisions you make based on them.

9. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits or revenue. Our aggregate liability for any claim arising out of or relating to these Terms or the service will not exceed the amount you paid us for the service in the 12 months preceding the event giving rise to the claim.

10. Indemnification

You will defend, indemnify, and hold harmless MyHotelOps from and against any third-party claims arising out of your use of the service, your Customer Content, or your breach of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-product notice at least 7 days before they take effect. Continued use of MyHotelOpsafter the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. The exclusive forum for any dispute is the state or federal courts located in Sacramento County, California, and the parties consent to the jurisdiction and venue of those courts.
